Rental and Lease Conditions for Measuring Devices
1. Definition and Subject of Contract
(1) The devices are provided as rental or loan units, not for purchase. The contracting party (“lessee”) receives the device for the agreed rental period.
(2) Ownership remains with the lessor. A right of return as with purchase contracts does not apply unless otherwise stated below.
2. Start and End of Rental Period
(1) The rental period begins on the delivery date as documented by the tracking information of the shipping service provider.
(2) The rental period ends on the dispatch date of the return shipment, also verified via tracking information.
(3) Delays or late returns automatically extend the rental period accordingly.
3. Inspection and Handover
(1) Before each shipment, the device is checked for proper function, tightness, and compliance with the specified accuracy class.
(2) A test certificate according to EN 10204 (3.1) can be issued upon request.
(3) The lessee must inspect the device immediately upon receipt and report visible damage within two days.
4. Permitted Media / Use
(1) The device may only be used with non-aggressive, non-viscous, and non-sticky media such as air, water, or neutral gases.
(2) Use with aggressive, acidic, highly viscous, or adhesive media is prohibited. For such applications, a purchase device is required.
(3) The lessee is liable for any damage resulting from improper use.
5. Rental Duration and Return
(1) The rental duration is agreed on a weekly basis (e.g. 1 – 12 weeks).
(2) The device must be properly packaged and returned by the final rental day.
(3) Late returns may be charged as an additional rental week.
6. Purchase Option
After the rental period, the device can be purchased. In that case, only the difference to the new price will be invoiced.
7. Liability and Obligations
(1) The lessee is liable for loss, damage, or improper handling of the device.
(2) The lessor is liable only for damages caused intentionally or through gross negligence.
8. Miscellaneous
(1) German law applies.
(2) Place of performance and jurisdiction is the registered office of the lessor.
(3) Amendments or additions must be made in writing.
